| COVENANT
|
- The protective covenants, conditions and restrictions set forth herein shall apply to the Property and shall be covenants running with the land and shall be binding on all parties, persons or entities owning the property for a period of twenty (20) years from the date hereof, or longer as may be allowed by law.
- The Property shall be known and described as residential and shall be used for residential purposes only. The Property shall not be subdivided no more than one (1) single family residence shall be constructed on any Tract on the Property.
- No more than one residential dwelling and one outbuilding which shall include a barn, garage or workshop shall be constructed on any Tract on the Property without the express written consent of Declarant prior to construction.
- No junk cars, or cars without a current year tag, will be placed or put upon any of the Property at any time.
- No vehicles with more than 10 wheels will be allowed on the Property.
- No mobile homes, pre-fabricated homes, modular or moved-in homes shall be permitted on any Property.
- No Recreational vehicles or campers will be located closer to any street than the rear of the residence. No Recreational vehicles or campers shall be used as a dwelling.
- Boats and recreational vehicles which cannot be used for a permanent residence on the Property shall be allowed to be stored on the Property once the permanent residence is complete. Such storage shall be to the rear of any residence.
- No playground equipment, clothes lines, swings or privacy or fences will be allowed closer to the street than the rear of any residence.
- No fences may be erected or maintained within the boundary of any easements as designated on the subdivision plat. All fences will be wood or vinyl and must be approved by Declarant in writing prior to installation.
- All drainage areas must be maintained, mowed, and generally well-kept at all times by property owner. No activity which will create erosion shall be undertaken except for initial construction of dwelling.
- Trash, garbage and other waste shall not be kept except in sanitary containers located at the rear of the dwelling. All refuse must be disposed of properly.
- No temporary house, camper, trailer, or tent shall be placed or put upon the property for use as a residence.
- No business, commercial, trade or manufacturing activity shall be conducted on the Property.
- No metal buildings of any kind shall be permitted to be located on the Property.
- No exposed concrete block shall be permitted on any structure.
- No dwelling shall be constructed having less than 1200 square feet heated above ground floor space. This shall exclude basements, garages, covered walkways and porches.
- No satellite dish, including the small or mini-dishes, shall be located closer to the street than the rear of the house, and any such satellite dish shall not be visible from the street.
- No animals can be raised for commercial or breeding purposes. The total number of farm animals such as goats, horses and cattle shall be limited to one (1) animal per two (2) acres of land. No pigs or hogs shall be permitted on the Property.
- No chicken or poultry houses of any kind shall be permitted on the Property.
- All outbuildings shall be the same color or same material as the dwelling erected on the Property and no used outbuildings shall be allowed.
- Exterior siding and foundation walls shall be approved by the Declarant in writing prior to commencement of construction of any dwelling on the Property.
- The yard shall be landscaped with grass and ornamental shrubs in a standard fashion. Every yard shall be maintained in a proper fashion and at all times the grass may not exceed six (6") inches in height. The Property shall not be prepared for the purpose of providing, or used for, a track for off road all terrain vehicles or motorcycles.
- All residences shall have a minimum set back as follows:
- one hundred (100’) feet from the front portion of any Tract; and
- seventy-five (75’) feet from any side property line; and
- one hundred (100’) feet from the rear of any Tract.
- No offensive activity shall be allowed upon any lot, nor shall anything be done which may be an annoyance or a nuisance to the neighborhood. No hunting or discharging of firearms shall be permitted at any time on the Property.
- No signs whatsoever shall be installed, altered or maintained on any lot, or on any portion of a structure visible from the exterior thereof, except:
- such signs as may be required by legal proceedings;
- not more than one "For Sale" or "For Rent" sign; provided, however, that in no event shall any such sign be larger than four square feet in area; and provided further that the language contained on any such sign shall be restricted to advertising the fact that the property is for sale or rent and for no other purpose; following the consummation of the sale or rental of any lot, the "for sale" or "for rent" sign located thereon shall be removed immediately;
- directional signs for vehicular or pedestrian safety; and
- such signs as may be required by Declarant or builder.
- All propane tanks or other such other tanks located on the Property must be buried or completely screened from view from all angles and not visible to any neighbor or from the street.
- No rubbish or debris of any kind shall be dumped, placed, or permitted to accumulate upon any portion of the Property.
- All mailboxes must be black metal or black plastic and mounted on a wood post only and maintained and kept in good repair.
- All construction must be completed within twelve (12) months of the inception of same. All construction debris must be promptly removed and no such debris or construction materials shall be permitted to be buried on the Property.
- Any repair to home which is a nuisance to adjoining property owners or a decreasing of value to any other property owner shall not be allowed. Maintenance and upkeep of all dwellings is a requirement at all times.
- No trees shall be removed that has a diameter of greater than four (4”) inches at a point one (1’) foot as measured from the ground. The only time trees can be removed from any Property shall be during the construction of the permanent residence.
- All construction plans for the permanent residence shall be pre-approved in writing by Declarant or his successor in interest. So too will any tree removal plan as it must also be submitted for approval in writing by Declarant prior to removal of any trees from the Property.
- Any driveways, ditches, entrances or roads on property are the responsibility of homeowners to maintain.
- Covenants, Conditions and Restrictions made and published not obtained by homeowner, will be resolved at the homeowners expense. Notification shall be given thirty (30) days before legal action will be taken.
- Enforcement shall be by proceedings at law or in equity against any person or persons violating or attempting to violate any covenant either to restrain violation or to recover damages. The failure to enforce promptly the provisions of these covenants shall, at no time, be considered as a waiver of future rights to enforce compliance.
- Invalidation of any one of theses covenants or any part thereof by judgment
or court order shall in no wise affect any of the other provisions, which shall
remain in full force and effect.
